TERMS & CONDITIONS

Welcome to AKS Ensemble. By accessing or using our website and services, you agree to be bound by the following Terms & Conditions. Please read them carefully before making a purchase.

1. General

These Terms & Conditions apply to all users of the website, including browsers, customers, and contributors of content. AKS Ensemble reserves the right to update or change these terms at any time without prior notice. The version published at the time of your order applies to that order.

This website is operated by Charu Datta, trading as AKS Ensemble, with its registered office at Basement, R 520 New Rajinder Nagar, New Delhi, Delhi, India, 110060. 

2. Products & Availability

  • All products are subject to availability.
  • Our pieces are largely handcrafted. Hand embroidery, hand block printing and natural dyes carry slight irregularities, and these are characteristic of the craft rather than defects.

  • Colours - We have made every effort to display the colours of our products as accurately as possible. However, as computer monitors, tablets and mobile devices vary, we cannot guarantee that your device's display of a colour will be completely accurate.

  • We reserve the right to discontinue or modify any product without notice.

3. Made to Order

  • Every piece is cut and finished to measurements confirmed with you before your order is placed and before any payment is taken.
  • Standard delivery is 30 to 45 days from confirmation of order and measurements. Timelines during wedding and festive season may be longer, and will be confirmed at the time of order.
  • Fit guidance is provided in good faith. The garment is cut to the measurements confirmed with you.

4. Pricing

  • All prices are listed in INR (₹) unless stated otherwise.
  • For Indian customers, prices are inclusive of all applicable taxes and duties.
  • For international customers, prices are exclusive of import duties, customs and local sales taxes.
  • Prices are subject to change without prior notice. The price applicable to your order is the price displayed at the time your order is confirmed.

5. Orders & Payments

  • An order is confirmed only after successful payment.
  • AKS Ensemble reserves the right to cancel or refuse any order due to stock unavailability, pricing errors, or suspected fraudulent activity.
  • If we decline an order after payment has been received, the amount will be refunded in full.

6. Shipping & Delivery

  • Delivery is complimentary within India. International shipping charges apply and are billed at cost.
  • International orders are shipped on a DDU basis. As the recipient, you are liable for all import duties, customs and local sales taxes levied in your country, payable at the time of delivery.
  • Delivery timelines are estimates and may vary based on location and external factors.
  • AKS Ensemble is not responsible for delays caused by courier partners, customs, weather conditions, or unforeseen circumstances.
  • Customers must provide accurate shipping details; we are not liable for delivery issues arising from incorrect information.

7. Returns, Exchanges & Alterations

  • As every garment is made to order and cut to your measurements, we are unable to offer returns or exchanges.
  • In the event of a manufacturing defect, please contact us within 7 days of delivery and we will repair or replace the piece at no cost to you.
  • The first alteration is complimentary. Subsequent alterations are chargeable, depending on the work required.
  • Alterations arising from a change in the customer's measurements after the order is placed, or from a change of preference, are chargeable from the first instance.
  • Requests for alteration must be made within 15 days of delivery.

8. Store Appointments

Appointments at our store at The Dhan Mill Compound, Chhatarpur are by prior confirmation. We ask that you inform us in advance if you are unable to attend, so the time may be offered to another client.

9. Intellectual Property

All content on this website — including images, designs, logos, text, and graphics — is the intellectual property of AKS Ensemble and may not be copied, reproduced, or used without prior written permission. Our garment designs may not be reproduced or manufactured by any third party.

10. User Conduct

You agree not to:

  • Use the website for any unlawful purpose
  • Attempt to disrupt or compromise the website's security
  • Extract data from the website by automated means
  • Misuse content, images, or branding belonging to AKS Ensemble

11. Customer Content

If you share photographs, reviews or other content with us, or tag us on social media, you grant us a non-exclusive right to use that content in our marketing, with credit. You may withdraw this at any time by writing to us.

12. Third-Party Links

Our website may contain links to third-party websites. AKS Ensemble is not responsible for the content, accuracy, or practices of these external sites.

13. Limitation of Liability

To the extent permitted by law, our liability in relation to any order is limited to the value of that order. AKS Ensemble shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or products.

Nothing in these Terms limits your rights under the Consumer Protection Act, 2019.

14. Force Majeure

We are not liable for delay or failure to perform arising from events beyond our reasonable control, including natural disaster, strike, courier or customs delay, government restriction, or failure of communications networks.

15. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts at New Delhi.

16. Grievance Redressal

In accordance with the Consumer Protection (E-Commerce) Rules, 2020:
